End User License Agreement

1. Definitions:
   In this End User License Agreement (“EULA”), “Licensor”, “we”, or “us” refers to the maintainers and developers of the software distributed under the name Mission Vishwakarma. “You” or “Licensee” refers to any individual or entity installing, using, or accessing the Software. “Software” refers to the binary executable form of any application developed by the Licensor.
2. Trademarks and Endorsement:
   “Mission Vishwakarma” and associated terms are trademarks and intellectual property of Ram Shanker. You may not use these trademarks, nor imply endorsement by the Licensor, without prior written permission.
3. Source Code License:
   The source code of the Software may be available under a separate source-available license. Please refer to the relevant GitHub repository for licensing terms.
4. NO WARRANTY:
   THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES RESULTING FROM USE OF THE SOFTWARE.
5. LIMITATION OF LIABILITY:
   IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, THE LICENSOR’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE, IF ANY.
6. License Grant:
   Subject to the terms of this Agreement, Licensor grants you a non-exclusive, non-transferable, revocable license to install and use the Software for your internal business or personal purposes.
7. Authorized Installation:
   You agree to install and use the Software only on systems where you have the legal right to install and use software on such systems.
8. Export Control:
   You acknowledge that the Software may be subject to export control laws and agree to comply with all applicable international and national export control regulations.
9. Data Collection and Use:
   By installing or using the Software, you consent to the collection of usage data, including but not limited to system specifications and usage logs. This data may be used for product improvement, marketing, research, statistical analysis, and may be shared with third parties, including government entities, where legally required. 10. Support Files:
    Files submitted as part of support requests may be used to improve the Software. We reserve the right to anonymize and publish such data unless otherwise specified by you at the time of submission.
11. Software Updates:
    The Software may be updated automatically without prior notice. Such updates may add, remove, or modify features.
12. Incorporating Usage or Extensions:
    The Licensor reserves the right to incorporate commonly used patterns, user-suggested features, or third-party extensions into future versions of the Software, without any obligation to credit or compensate contributors.
13. Termination Due to Legal Action:
    If you initiate legal proceedings against the Licensor (patent-related or software IP related), your license to use the Software shall terminate immediately, and you must cease all use and delete all copies.
14. Reverse Engineering and Format Interoperability:
    If you develop proprietary software that reads or writes to our file format, you agree that the Licensor may implement reverse compatibility, including reverse engineering your format to the extent permitted by applicable law.
15. Lawful Use:
    You agree not to use the Software for any activity that is unlawful under applicable local, national, or international law including but not limited to activities that infringe intellectual property rights, violate privacy laws, or constitute cybercrime.
16. Business Usage and Attribution
    If you are a business entity or organization and use the Software for any purpose, you grant the Licensor a perpetual, worldwide, royalty-free, non-exclusive right to use your name and logo in the Licensor’s website, presentations, and marketing materials, for the sole purpose of indicating that your organization uses the Software. You represent and warrant that you have the authority to grant this permission on behalf of your organization.
17. Governing Law:
    This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
18. Severability:
    If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement:
    This EULA constitutes the entire agreement between you and the Licensor and supersedes all prior understandings. Nothing in this Agreement affects your statutory consumer rights that cannot be excluded or limited by law.
20. EULA Updates:
    We may update this EULA occasionally to reflect changes in law or software functionality. We will notify you of significant changes through the software interface or other reasonable means. Your continued use of the Software after such notification constitutes acceptance of the updated terms.
